Effective Date: February 24, 2026

These Terms & Conditions govern the services provided by SafeGuard Pest Pros (“Company,” “we,” “our,” or “us”). By authorizing service, signing an estimate, or scheduling service, you agree to the following terms.

 Safeguard Pest Pros – Service Agreement Terms & Conditions

1. SERVICE AGREEMENT Safeguard Pest Pros (“the Company”) agrees to provide pest control services at the service address listed on this agreement or receipt.  
2. SCOPE OF SERVICE The Company will provide pest control at the frequency agreed upon for the pests listed. All standard service agreements are for general pest control only. Additional charges may apply for wood-destroying insects or any pests outside the general pest category.  
3. ACCESS TO PROPERTY The customer agrees to make the property accessible for inspection and/or treatment as needed to control the pests listed in this agreement.  
4. TERM OF AGREEMENT This agreement will remain in effect indefinitely until canceled by the customer or Safeguard Pest Pros.  
5. CANCELLATION POLICY Either party may cancel this agreement with thirty (30) days written notice. Customers may cancel at any time and are responsible only for outstanding invoice balances prior to giving notice.  
6. PRICE CHANGES Safeguard Pest Pros reserves the right to adjust service fees when necessary.  
7. LIMITATION OF LIABILITY FOR DAMAGES SafeGuard Pest Pros shall not be responsible for pre-existing damages, concealed conditions, or damages caused by pests prior to treatment. The Company’s liability for any claim related to services provided shall be limited to the amount paid for the specific service performed.
8. WOOD-DESTROYING INSECTS EXCLUSION  Unless specifically stated in writing on the invoice or service agreement, services provided by SafeGuard Pest Pros do not include inspection, treatment, control, or repair of termites or other wood-destroying organisms. SafeGuard Pest Pros is not responsible for damages caused by wood-destroying organisms unless covered under a separate written termite or wood-destroying insect agreement. 
9. HEALTH-RELATED CLAIMS The customer agrees that any claims arising from alleged health issues affecting tenants, guests, or family members are the sole responsibility of the property owner. Safeguard Pest Pros is not liable for any complaints, litigation, or legal actions related to contamination or infestation.  
10. PROPERTY DAMAGE Limitations  SafeGuard Pest Pros shall exercise reasonable care during treatment and installation of pest-control products. The Company is not responsible for damages resulting from concealed conditions, inaccessible areas, pre-existing defects, improper construction, hidden utilities, or conditions beyond the Company’s reasonable control. Customer agrees to notify the Company of any known hazards, hidden utilities, or special conditions prior to service. 
11. WEATHER & SCHEDULING The Company may reschedule services at any time due to weather or unforeseen circumstances. Safeguard Pest Pros reserves the right to cancel service at any time.  
12. PERMITS The property owner is responsible for obtaining any required permits unless specifically noted otherwise.  
13. COLLECTIONS & FEES Invoices not paid within thirty (30) days of the service date may be assessed a late fee equal to five percent (5%) of the outstanding balance or a minimum late fee of $10.00, whichever is greater. SafeGuard Pest Pros reserves the right to suspend future services on delinquent accounts.                                                              Customer agrees to pay all reasonable collection costs, attorney fees, court costs, and related expenses incurred in collecting unpaid balances. SafeGuard Pest Pros reserves all legal rights available under West Virginia law to recover unpaid amounts.
14. CREDIT CARD AUTHORIZATION  By providing a credit or debit card on file, the customer authorizes SafeGuard Pest Pros to charge approved invoices, outstanding balances, applicable late fees, and authorized recurring services. A processing fee may apply to card transactions where permitted by law. 
15. MANDATORY ARBITRATION  Any dispute arising from services performed by SafeGuard Pest Pros shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration in the State of West Virginia prior to court action, except for collection matters or unpaid balances owed to the Company. 
16. INSUFFICIENT FUNDS  Returned checks, declined electronic payments, chargebacks, or insufficient funds transactions will incur a $35.00 returned payment fee in addition to any outstanding balance owed. 
17. SALES TAX All services may be subject to applicable state and local sales tax.
